Similarly, the provision of personal data by a user using the Website is voluntary, except in cases where it is necessary to use certain functionalities of the Website, including, for example, the contact form. Failure to provide personal data, in cases and to the extent required, necessary to use a given functionality of the Website results in the inability to use that functionality. In each case, the scope of data required to use a Website functionality is indicated by the Administrator on the Website (e.g. before completing a quote request form).   <\/p>\n\n<p class=\"wp-block-paragraph\">The Administrator exercises particular care to protect the interests of the persons whose personal data it processes, and in particular is responsible for and ensures that the data it collects is: (1) processed lawfully; (2) collected for specified, lawful purposes and not subjected to further processing inconsistent with those purposes; (3) substantively correct and adequate in relation to the purposes for which they are processed; (4) stored in a form permitting identification of the persons concerned for no longer than is necessary to achieve the purpose of the processing; and (5) processed in a manner ensuring appropriate security of personal data, including protection against unauthorized or unlawful processing and accidental loss, destruction, or damage, through the use of appropriate technical or organizational measures.<br\/><\/p>\n\n<p class=\"wp-block-paragraph\">Taking into account the nature, scope, context, and purposes of processing, as well as the risk of violating the rights or freedoms of natural persons with varying degrees of likelihood and severity of threat, the Administrator implements appropriate technical and organizational measures to ensure that processing is carried out in accordance with the GDPR Regulation and to be able to demonstrate this. These measures are reviewed and updated as necessary. The Administrator applies technical measures to prevent unauthorized persons from acquiring and modifying personal data transmitted electronically.<br\/>  <\/p>\n\n<p class=\"wp-block-paragraph\">All words, expressions, and acronyms appearing in this privacy policy and beginning with a capital letter should be understood in accordance with their meaning as set out in this document.<br\/><\/p>\n\n<h2 class=\"wp-block-heading\">LEGAL DISCLAIMER<br\/><\/h2>\n\n<p class=\"wp-block-paragraph\">The Site is informational in nature, allowing visitors to learn about the products and services of the Site Owner and to contact them, among other things, by submitting an inquiry through the contact form or the inquiry configurator. The Site may also feature a newsletter, the subject of which will be informing about the activities, news, and new products and services of the Site Owner. The Site, the products and services available on it, and the terms of service are addressed exclusively to entrepreneurs, meaning the Site is not addressed to consumers. Polish law is the governing law for the Site and these terms of service, as well as for agreements concluded on their basis.<br\/>     <\/p>\n\n<p class=\"wp-block-paragraph\">The Site is not an online store, and it is not possible to conclude a sales agreement for the Site Owner&#8217;s products and services through it (this means, among other things, that advertisements, price lists, and other information about products and services published on the Site should not be treated as an offer, but possibly as an invitation to conclude an agreement). A sales agreement may be concluded as a result of an inquiry submitted to the Site Owner and only after the parties have agreed on the detailed terms of such an agreement &#8211; however, the conclusion and terms of such an agreement are governed by a separate sales agreement or separate general terms of sale of products by the Site Owner, which will be made available by them.<br\/> <\/p>\n\n<p class=\"wp-block-paragraph\">The Owner makes every effort to ensure that the data presented on the Site is current and consistent with the actual state of affairs. At the same time, the Owner reserves that all content available on the Site is for informational purposes only.<br\/> <\/p>\n\n<h2 class=\"wp-block-heading\"><strong>GROUNDS FOR DATA PROCESSING<br\/><\/strong><\/h2>\n\n<p class=\"wp-block-paragraph\">The Administrator is entitled to process personal data in cases where &#8211; and to the extent that &#8211; at least one of the following conditions is met: (1) the data subject has given consent to the processing of their personal data for one or more specific purposes; (2) processing is necessary for the performance of a contract to which the data subject is a party, or in order to take steps at the request of the data subject prior to entering into a contract; (3) processing is necessary for compliance with a legal obligation to which the Administrator is subject; or (4) processing is necessary for the purposes of the legitimate interests pursued by the Administrator or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child.<br\/><\/p>\n\n<p class=\"wp-block-paragraph\">Processing of personal data by the Administrator requires, in each case, at least one of the grounds indicated above. The limitation period is determined by law, in particular the Civil Code (the basic limitation period for claims related to business activity is three years). <\/td><\/tr><\/tbody><\/table><\/figure>\n\n<p class=\"wp-block-paragraph\"><strong>RECIPIENTS OF DATA ON THE WEBSITE<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">For the proper functioning of the Website, it is necessary for the Administrator to use the services of external entities (such as a software provider). The Administrator uses only the services of such processing entities that provide sufficient guarantees of implementing appropriate technical and organizational measures, so that the processing meets the requirements of the GDPR Regulation and protects the rights of the data subjects. <\/p>\n\n<p class=\"wp-block-paragraph\">The Administrator does not transfer data in every case and not to all recipients or categories of recipients indicated in the privacy policy &#8211; the Administrator transfers data only when it is necessary to achieve a given purpose of personal data processing and only to the extent necessary to achieve it.<\/p>\n\n<p class=\"wp-block-paragraph\">Personal data may be transferred by the Administrator to a third country, with the Administrator ensuring that in such a case this will take place with respect to a country providing an adequate level of protection &#8211; consistent with the GDPR Regulation, and in the case of other countries, that the transfer will take place on the basis of standard data protection clauses. The Administrator ensures that the data subject has the opportunity to obtain a copy of their data. The Administrator transfers collected personal data only in the case and to the extent necessary to achieve a given purpose of data processing consistent with this privacy policy.  <\/p>\n\n<p class=\"wp-block-paragraph\">Personal data of Website users may be transferred to the following recipients or categories of recipients:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>service providers supplying the Administrator with technical, IT, and organizational solutions, enabling the Administrator to conduct business activity, including the Website and the electronic services provided through it (in particular providers of computer software for running the Website, email and hosting providers, and providers of software for company management and providing technical support to the Administrator) &#8211; the Administrator shares the collected personal data of the Website user with the selected provider acting on its behalf only in the case and to the extent necessary to achieve a given purpose of data processing consistent with this privacy policy.<\/li>\n\n\n\n<li>providers of legal and advisory services providing the Administrator with accounting, legal, or advisory support (in particular a law firm) &#8211; the Administrator shares the collected personal data of the Website user with the selected provider acting on its behalf only in the case and to the extent necessary to achieve a given purpose of data processing consistent with this privacy policy.<\/li>\n\n\n\n<li>providers of social plugins, scripts, and other similar tools placed on the Website that enable the browser of a person visiting the Website to download content from the providers of the aforementioned plugins (e.g. watching a video, liking, sharing) and to transfer the personal data of the visitor to these providers for this purpose, including:\n<ul class=\"wp-block-list\">\n<li>Meta Platforms Ireland Ltd. &#8211; the Administrator may use social plugins of Facebook or Instagram and\/or Facebook and Instagram advertising pixels, and in connection with this, collect and share data of the device or person using the Site with Meta Platforms Ireland Ltd. (4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland) to the extent and in accordance with the privacy policy available here: https:\/\/www.facebook.com\/about\/privacy\/ and https:\/\/privacycenter.instagram.com\/policy (this data includes information about activities on the Site &#8211; including information about the device, websites visited, advertisements displayed, and the manner of using the services &#8211; regardless of whether the person using the Site has a Facebook \/ Instagram account and whether they are logged into their Facebook \/ Instagram account).  <\/li>\n\n\n\n<li>Google Ireland Ltd. &#8211; the Administrator may use Google plugins and\/or Google advertising pixels on the Site, and in connection with this, collect and share data of the device or person using the Site with Google Ireland Ltd. (Gordon House, Barrow Street, Dublin 4, Ireland) to the extent and in accordance with the privacy policy available here: https:\/\/policies.google.com\/privacy?hl=en (this data includes information about activities on the Site &#8211; including information about the device, websites visited, advertisements displayed, and the manner of using the services) &#8211; regardless of whether the person using the Site has a Google account and whether they are logged into their Google account.  <\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>PROFILING ON THE SITE<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">The GDPR Regulation imposes on the Administrator an obligation to inform about automated decision-making, including profiling, referred to in Article 22(1) and (4) of the GDPR Regulation, and &#8211; at least in these cases &#8211; meaningful information about the rules for making such decisions, as well as about the significance and anticipated consequences of such processing for the data subject. Bearing this in mind, the Administrator provides in this section of the privacy policy information regarding possible profiling.   <\/p>\n\n<p class=\"wp-block-paragraph\">The Administrator may use profiling on the Site for direct marketing purposes, but decisions made on this basis by the Administrator do not concern the conclusion or refusal to conclude a contract or the possibility of using electronic services. The effect of using profiling on the Site may be, for example, granting a given person a discount, sending them a discount code, sending them a product proposal that may match the interests or preferences of a given person, or proposing better terms compared to the standard offer. Despite profiling, it is the given person who freely decides whether they want to take advantage of the discount obtained in this way, or better terms, and make a purchase.  <\/p>\n\n<p class=\"wp-block-paragraph\">Profiling on the Site consists of automatic analysis or prediction of a given person&#8217;s behavior on the Site, for example by browsing the page of a specific Product on the Site. A condition for such profiling is that the Administrator possesses the personal data of a given person, in order to be able to subsequently send them, for example, a discount code. <\/p>\n\n<p class=\"wp-block-paragraph\">The data subject has the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or similarly significantly affects them.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>RIGHTS OF THE DATA SUBJECT<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Right of access, rectification, restriction, erasure, or portability &#8211; the data subject has the right to request from the Administrator access to their personal data, its rectification, erasure (&#8220;the right to be forgotten&#8221;), or restriction of processing, and has the right to object to processing, as well as the right to data portability. Detailed conditions for exercising the above rights are set out in Articles 15-21 of the GDPR Regulation.  <\/p>\n\n<p class=\"wp-block-paragraph\"><strong>Prawo do cofni\u0119cia zgody w dowolnym momencie<\/strong> \u2013 osoba, kt\u00f3rej dane przetwarzane s\u0105 przez Administratora na podstawie wyra\u017conej zgody (na podstawie art. 6 ust. 1 lit. a) lub art. 9 ust. 2 lit. a) Rozporz\u0105dzenia RODO), ma prawo do cofni\u0119cia zgody w dowolnym momencie bez wp\u0142ywu na zgodno\u015b\u0107 z prawem przetwarzania, kt\u00f3rego dokonano na podstawie zgody przed jej cofni\u0119ciem.  <\/p>\n\n<p class=\"wp-block-paragraph\">Right to lodge a complaint with a supervisory authority &#8211; a person whose data is processed by the Administrator has the right to lodge a complaint with a supervisory authority in the manner and procedure specified in the provisions of the GDPR Regulation and Polish law, in particular the Personal Data Protection Act. The supervisory authority in Poland is the President of the Personal Data Protection Office (UODO). <\/p>\n\n<p class=\"wp-block-paragraph\">Right to object &#8211; the data subject has the right to object at any time, on grounds relating to their particular situation, to the processing of their personal data based on Article 6(1)(e) (public interest or tasks) or (f) (legitimate interest of the controller), including profiling based on these provisions. In such a case, the Administrator shall no longer be permitted to process this personal data unless it demonstrates the existence of compelling legitimate grounds for processing that override the interests, rights, and freedoms of the data subject, or grounds for establishing, pursuing, or defending claims.     <\/p>\n\n<p class=\"wp-block-paragraph\">Right to object regarding direct marketing &#8211; if personal data is processed for direct marketing purposes, the data subject has the right to object at any time to the processing of their personal data for such marketing purposes, including profiling, to the extent that the processing is related to such direct marketing.<\/p>\n\n<p class=\"wp-block-paragraph\">In order to exercise the rights referred to in this section of the privacy policy, you can contact the Administrator by sending an appropriate message in writing or by email to the Administrator&#8217;s address indicated at the beginning of the privacy policy.<\/p>\n\n<p class=\"wp-block-paragraph\"><strong>COOKIES ON THE WEBSITE AND ANALYTICS, REMARKETING<\/strong><\/p>\n\n<p class=\"wp-block-paragraph\">Cookie files (cookies) are small pieces of text information in the form of text files, sent by a server and saved on the side of the person visiting the Website (e.g. on the hard drive of a computer, laptop, or on the memory card of a smartphone &#8211; depending on which device the visitor to our Website is using). Detailed information on cookies, as well as the history of their creation, can be found, among other places, here: <a href=\"https:\/\/pl.wikipedia.org\/wiki\/HTTP_cookie\">https:\/\/en.wikipedia.org\/wiki\/HTTP_cookie.<\/a>    <\/p>\n\n<p class=\"wp-block-paragraph\">The Administrator provides on the Site a tool for easy and active management of Cookies &#8211; available upon first visiting the Site, and subsequently available in the Site&#8217;s footer. Active management allows, among other things, checking which Cookies are or may be saved while using the Site, as well as selecting and later changing the scope and purposes of using Cookies in relation to the device and the person visiting the Site. When starting to use the Site, the visitor will be asked to select cookie settings. It is possible to change them later by changing the settings within this tool available on the site.   <\/p>\n\n<p class=\"wp-block-paragraph\">In the privacy policy, the Administrator provides a range of information regarding the use of Cookies on the Site, their types and purposes of use, and managing them using, for example, web browser settings and the cookie management tool available on the Site. The Administrator encourages the use of the cookie management tool available on the Site, which allows for easy active management of Cookies while using the Site. <\/p>\n\n<p class=\"wp-block-paragraph\">Cookies that may be sent by the Website can be divided into various types, according to the following criteria:<\/p>\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td>By their provider: 1) own (created by the Administrator&#8217;s Website) and 2) belonging to third parties\/entities (other than the Administrator) <\/td><td>By their storage period on the device of the person visiting the Website: 1) session (stored until leaving the Website or closing the web browser) and 2) persistent (stored for a specified time, defined by the parameters of each file, or until manually deleted) <\/td><td>By their purpose of use: 1) necessary (enabling the proper functioning of the Website), 2) functional\/preference (enabling the Website to be adapted to the preferences of the person visiting the site), 3) analytical and performance (collecting information about how the Website is used), 4) marketing, advertising, and social media (collecting information about the person visiting the Website in order to display advertisements to that person, personalize them, measure their effectiveness, and conduct other marketing activities, including on websites separate from this Website, such as social media platforms or other websites belonging to the same advertising networks as the Website)   <\/td><\/tr><\/tbody><\/table><\/figure>\n\n<p class=\"wp-block-paragraph\">The Administrator may process data contained in Cookies while visitors use the Website for the following specific purposes:<\/p>\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td rowspan=\"4\"><strong>Purposes of using Cookies on the Administrator&#8217;s Website<\/strong><\/td><td>remembering data from completed forms (necessary and\/or functional\/preference Cookies)<\/td><\/tr><tr><td>adapting the content of the Website to individual user preferences (e.g. regarding colors, font size, page layout) and optimizing the use of the Website (functional\/preference Cookies)<\/td><\/tr><tr><td>conducting anonymous statistics showing how the Website is used (analytical and performance Cookies)<\/td><\/tr><tr><td>displaying and rendering advertisements, limiting the number of ad impressions, and ignoring advertisements that the user does not want to see, measuring the effectiveness of advertisements, as well as personalizing advertisements, that is, studying the behavioral characteristics of visitors to the Website through anonymous analysis of their actions (e.g. repeated visits to specific pages, keywords, etc.) in order to create their profile and deliver advertisements tailored to their expected interests, including when they visit other websites within the advertising network of Google Ireland Ltd. and Facebook, i.e. Meta Platforms Ireland Ltd.
